Our website policies are designed with you, the customer, in mind to ensure that your online shopping experience with Swirl Creations Limited will be secure, prompt, efficient and hassle-free.

The E-Commerce online purchase service is provided to you subject to the following Terms and Conditions. If you visit or shop at swirlcreations.co.nz you accept those terms and conditions.

If you do not accept these Terms and Conditions you may not access or use this site.

You must be aged 18 years or over to use this service. Completing an online order is a declaration to us that you are aged 18 years or over.

This Terms and Conditions document governs the use of Swirl Creations' Online Service (the Service). You can access this Agreement at any time from the bottom of any page of the site.

Definitions

"Content" means all information, data, text, software, music, sound, photographs, graphics, video, messages or other material.

"You/Your" means you, the user of this web site.

"We/Us/Our" means Swirl Creations Limited who provides this web site.

Shipments

Packages are generally dispatched within 2 days after receipt of payment and are shipped via NZ Post using your choice of parcel post or courier post with tracking and drop-off without signature. Whenever possible with your shipment choice, we will provide you with a link to track your package online.

Shipping fees include handling and packing fees as well as postage costs. Handling fees are fixed, whereas transport fees vary according to total weight of the shipment. We advise you to group your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Your package will be dispatched at your own risk, but special care is taken to protect fragile objects.

Packages are amply sized and your items are well-protected.

Guarantee and Returns

Your rights under the Consumers Guarantees Act 1993 protect you. Please note however that the Consumers Guarantees Act does not cover the purchase of any goods for business purposes (excluding home office use).

Swirl Creations Limited  is committed to providing quality products to our customers. If for any reason you are not completely satisfied with any product, please return it to us in original condition within 14 days of receipt and we will replace it or refund your purchase price using the original payment method.

To return products to Swirl Creations Limited, please affix postage to your package and send it to our listed address. Unfortunately, your postage charges on returns are not refundable. However, if you are returning an item for exchange (i.e. the same style is being changed for a different size or colour), you are not required to pay for standard delivery on the outgoing replacement parcel.

Refunds

A refund will only be provided when it has been proven that there has been an overpayment or where we are obliged to provide a refund by law. When applying for a refund you must provide us with proof of the overpayment or provide reasons why the refund should be made.

Pricing

All prices in the shopping areas are in New Zealand dollars (NZ$) and include GST where required. Other currencies are provided for indicaitve purposes only. All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.

Delivery charges are calculated and added to your order after you enter your delivery location and before you enter your payment details. You get to see the full charge before completing your purchase.

You agree that, because of the nature of world wide Internet sales, the online purchase facility is provided by us on an ‘as is’ and ‘as available’ basis

We are not liable to you if we are unable to supply a particular item, or if any delay in supply is experienced. Items supplied for delivery outside New Zealand may be subject to local taxes and levies on delivery. These charges are the responsibility of the purchaser and do not constitute any part of the price charged by Swirl Creations Limited

Email

We only email you if you want us to. We do not send unsolicited emails. When you register your email address with us you go on a list to receive email announcements about products, offers and promotions from Swirl Creations Limited. We do not disclose your email address to third parties.

Every email message we send includes an email address to which you can respond. If at any time you decide you do not want to receive our emails, simply reply with the word “Unsubscribe” This will remove your email address from our mailing list. If you unsubscribe you will still receive emails specifically related to your online orders.

Amendments to these Terms and Conditions

We reserve the right, at any time, to modify, amend or update these terms and conditions without notice.

Laws

These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand and any dispute will be resolved only by the courts of New Zealand.
